General Terms and
Conditions

The provisions of Sections 651a–y of the German Civil Code (BGB) govern the conclusion and performance of the travel contract. Any discrepancies in the respective travel brochure, as well as individual agreements, take precedence over these terms and conditions of travel.

1. Conclusion of the Travel Contract

1.1 By registering for the trip—which may be done verbally, in writing, by telephone, by fax, or electronically—the traveler makes a binding offer to the tour operator to enter into a travel contract in accordance with the terms of the trip description. The scope of the contractual services is determined exclusively by the description of services in the travel advertisement for the relevant period (e.g., advertisement, the tour operator’s website, brochure), other pre-contractual information, and the details referring to these in the travel confirmation/invoice. Other brochures published by the hotel or service provider do not form part of this contract. The organizer’s employees are not authorized to make any verbal side agreements. The travel contract is concluded upon the traveler’s receipt of the written travel confirmation.

1.2 If the content of the travel confirmation differs from the content of the travel registration, this constitutes a new offer by the tour operator, to which the tour operator is bound for 10 days. The contract is concluded on the basis of this new offer if the traveler accepts it. Acceptance may be effected by a conclusive act, such as payment of the travel price, a down payment, or commencement of the trip.

1.3 If the traveler does not have the tour operator’s terms and conditions of travel and payment at the time of booking by phone, they will be sent along with the travel confirmation/invoice. The Terms and Conditions of Travel shall form an integral part of the travel contract, subject to the provisions of Section 1.2.

1.4 Travel agents (e.g., travel agencies) and service providers (e.g., hotels, transportation companies) are not authorized to enter into agreements on behalf of the tour operator, provide information, or make representations that alter the agreed-upon terms of the package tour contract, go beyond the services contractually promised by the tour operator, or contradict the tour brochure.

1.5 The pre-contractual information provided by the tour operator regarding the essential characteristics of the travel services, the travel price and all additional costs, the payment terms, the minimum number of participants, and the flat-rate cancellation fees (pursuant to Article 250, Section 3, Items 1, 3 through 5, and 7 of the EGBGB) shall not form part of the package travel contract unless this is expressly agreed upon by the parties.

1.6 Bookings made through our online booking system are subject to the information provided on our website and the travel terms and conditions available there.

1.7 In accordance with Regulation (EC) No. 2111/2005, the traveler will be informed of the identity of the operating air carrier at the time of booking. If this is not yet known at the time of booking, passengers will first be informed of the identity of the likely operating air carrier and will be notified again as soon as the identity is definitively determined. Any change in the operating airline after booking will be communicated immediately. The list of airlines subject to an EU operating ban (“Black List”) is available on the following website: https://transport.ec.europa.eu/transport-themes/eu-air-safety-list_en

2. Payment

2.1 Upon receipt of the travel confirmation, a deposit equal to 20% of the trip price is due in exchange for the issuance of the security certificate. The remaining balance is due 30 days before the start of the trip, without the need for a further reminder. For trip registrations made less than four weeks before the trip begins, the full trip price is due immediately upon receipt of the trip confirmation, and payment can be made at the time of registration via credit card or PayPal.

2.2 If you book online, you can pay for your trip by credit card or through PayPal. To do this, we need your address or, if applicable, of the recipient of the documents, as well as your consent to the charge on your credit card. You will also be presented with various payment options (one-time and two-time payments) to choose from.

2.3 If the down payment and/or the balance are not received on time, and if no payment is made even after a demand has been issued setting a deadline, the tour operator is entitled to cancel the travel contract and will charge the cancellation fees specified in Section 4.

3. Transfer, Reassignment, and Changes to Services

3.1 The traveler has the right to transfer the travel contract to another suitable person in accordance with §651e of the German Civil Code (BGB) within a reasonable period of time before the start of the trip. Once the contract has been concluded, the traveler has no right to request changes regarding the travel dates, destination, point of departure, accommodations, or mode of transportation (rebooking). Requests to change reservations must always be reviewed by the tour operator and, if a change is possible, will be subject to a minimum fee of 30.00 € per transaction, plus Any additional costs that may arise as a result of changes made by the service providers.

3.2 Prior to the conclusion of the contract, the tour operator may at any time make changes to the service descriptions; the traveler will be informed of such changes before booking. The tour operator is entitled to make unilateral changes or deviations to individual travel services from the agreed terms of the travel contract that become necessary after the contract is concluded, provided that these do not affect the travel price, are minor, and do not impair the overall nature of the trip. In particular, the tour operator is entitled, within this framework, to subsequently change the arrival and departure times as well as the specified airline to equivalent alternatives, provided that this becomes necessary for reasons arising after the conclusion of the travel contract and that such changes are reasonable for the traveler.

4. Cancellation by the Traveler

4.1 The traveler may cancel at any time. To avoid any misunderstandings, it is recommended that you submit your cancellation in writing to the tour operator or travel agent, specifying the travel contract number. Any travel documents that have already been provided must be returned. Instead, the organizer may demand reasonable compensation, taking into account the expenses that would normally have been saved and the income that could normally be earned by using the travel service for another purpose. Compensation will be calculated per person as follows, based on the date of receipt of the notice of cancellation (provided no replacement traveler is found):

  1. Bus Tours

4.2 The cancellation fees apply unless other terms have been agreed upon in individual solicitations or pre-contractual information. The traveler is free to prove that the tour operator incurred no damages at all or damages that were significantly lower than the lump-sum amount claimed by the tour operator.

4.3 It is recommended that you purchase travel cancellation insurance. The insurer may cover the cancellation costs in accordance with its insurance terms and conditions for the insured risks.

5. Cancellation by the Tour Operator

5.1 If the minimum number of participants required for the trip—which is fewer than 25 people per trip or fewer than the minimum number of participants expressly specified in the contract—is not reached, the tour operator may cancel the trip up to 5 weeks before the trip begins. In the event that the tour operator cancels the trip, the traveler is entitled to request participation in another trip of at least equal value, provided the tour operator is able to offer such a trip from its lineup at no additional cost to the traveler. The traveler must assert this right against the tour operator immediately after the tour operator has issued a notice of cancellation. If the traveler does not exercise his or her right to participate in an equivalent trip, the travel price paid will be refunded immediately.

5.2 The tour operator is entitled to terminate the travel contract without notice if, despite a warning, the traveler either disrupts the trip to such a significant degree or behaves in a manner so contrary to the contract that immediate termination of the contract is justified, including to protect other travelers. If the tour operator cancels the trip, it retains the right to the travel price, but must allow for a deduction for the value of the expenses saved as well as any benefits it derives from the alternative use of the unused services, including any income credited or reimbursed to it by the service providers.

6. Passport, Visa, and Health Requirements

6.1 The tour operator will inform nationals of the EU member state in which the trip is offered about passport, visa, and health requirements prior to the conclusion of the contract. For citizens of other countries, the relevant consulate can provide information. This assumes that there are no special circumstances (e.g., dual citizenship, statelessness).

6.2 The traveler is responsible for obtaining and carrying the travel documents required by the authorities, for any necessary vaccinations, and for complying with customs and foreign exchange regulations. All disadvantages resulting from noncompliance (e.g., cancellation fees) shall be borne by the participant, unless they are caused by the organizer’s culpable provision of incorrect information or failure to provide information.

6.3 The tour operator is not liable for the timely issuance and receipt of necessary visas by the respective diplomatic mission if the traveler has entrusted the tour operator with arranging them, unless the tour operator has breached its own obligations.

7. Liability

7.1. The organizer’s contractual liability for damages that are not bodily injury and were not caused by negligence is limited to three times the price of the trip. Any claims that may go beyond this limitation of liability under the Montreal Convention or the Air Transport Act remain unaffected by this limitation of liability.

7.2 The organizer’s tort liability for damages that are not bodily injury or damages related to sexual autonomy and that were not caused by negligence is limited to three times the price of the trip.

7.3 The tour operator is not liable for disruptions to services, personal injury, or property damage in connection with services that are merely arranged as third-party services (e.g., excursions, sporting events, theater performances, exhibitions, transportation services to and from the advertised departure and destination points), provided that such services are expressly identified as third-party services in the travel brochure and the booking confirmation—with the name of the contracted third-party provider specified—in a manner so clear that it is evident to the traveler that they are not part of the tour operator’s travel services and were selected separately. However, we are liable if and to the extent that your loss was caused by our breach of our duties to provide notice, information, or organizational support.

8. Duty to Cooperate

8.1 The person booking the trip or the traveler must notify the tour operator immediately if they have not received the necessary travel documents at least 7 days before the trip begins.

8.2 If the trip is not provided free of defects, the traveler may demand that the defects be remedied. To the extent that the organizer was unable to remedy the situation due to a culpable failure to report the defect, neither claims for a reduction in price under § 651m of the German Civil Code (BGB) nor claims for damages under § 651n of the German Civil Code (BGB) may be asserted. The traveler is required to report any defects immediately to the tour operator’s local representative. If there is no such representative at the vacation destination—or if the presence of such a representative is not contractually required—any issues with the trip must be reported to the tour operator at its headquarters. Information regarding the availability of the contact persons will be provided in the service description, or at the latest with the travel confirmation. The traveler may also bring the notice of defects to the attention of the travel agent through whom he or she booked the package tour. Tour guides or other representatives of the tour operator at the vacation destination are not authorized to acknowledge claims.

8.3 If the traveler terminates the travel contract due to a defect in the trip as described in § 651i, para. (2) If the consumer wishes to terminate the contract in accordance with § 651l of the German Civil Code (BGB) on the grounds specified therein, provided that the grounds are substantial, the consumer must first give the organizer a reasonable period of time to remedy the situation. This does not apply only if the organizer refuses to remedy the situation or if immediate remedial action is necessary.

8.4 In the event of damage to, loss of, or delays in the delivery of luggage during air travel, the tour operator strongly recommends that you report the incident immediately on the spot by filing a Property Irregularity Report (P.I.R.) with the relevant airline. Airlines generally refuse to issue refunds if the claim form has not been filled out. Claims for damaged baggage must be filed within 7 days, and claims for delayed baggage within 21 days, after delivery. In addition, the loss, damage, or misrouting of luggage must be reported to the tour operator or travel agent in accordance with Section 8.2.

8.5 Claims under § 651i, para. Claims under Section 3, Nos. 2–7 of the German Civil Code (BGB) must be asserted against the tour operator. A claim may also be filed through the travel agent if the travel services were booked through that travel agent. It is recommended that the claim be submitted on a durable medium.

9. Other Provisions

9.1 The data provided to the organizer will be processed, stored, and disclosed for the purposes specified in the contract, and will be used for promotional purposes to the extent permitted by law. The organizer’s privacy policy is available at https://www.sr-travel.de/Datenschutz. Personal data is protected in accordance with the applicable data protection regulations.

9.2 Obvious printing and calculation errors entitle the organizer to rescind the travel contract.

9.3 Information on Consumer Dispute Resolution
With regard to the Consumer Dispute Resolution Act, we would like to note that we do not participate in voluntary consumer dispute resolution. If consumer dispute resolution were to become mandatory for us, we would inform you, our customers, of this in an appropriate manner.

9.4 The invalidity of individual provisions shall not render the entire travel contract invalid. It is agreed that German law shall apply. For customers/travelers who are not nationals of a member state of the European Union or Swiss citizens, it is agreed that German law shall exclusively govern the entire legal and contractual relationship between the customer/traveler and the tour operator. Such customers/travelers may sue the tour operator only in the court of the tour operator’s registered office.

9.5 The foregoing terms and conditions shall apply only if and to the extent that no other provisions are stipulated by statutory regulations that take effect after this publication.
